End User Licence Agreement
This End User Licence Agreement ("EULA") is a legal agreement between you ("End User") and Foundry26 ("Licensor") for the Vael mobile application ("App"). By downloading, installing, or using the App, you agree to this EULA.
1. Licence Grant
Foundry26 grants you a personal, non-exclusive, non-transferable, revocable, limited licence to install and use Vael on a device that you own or control, solely for your personal, non-commercial purposes, subject to the terms of this EULA, the applicable App Store terms of service, and our Terms of Service.
2. Restrictions
You may not:
- Copy, modify, or distribute the App or any portion thereof
- Reverse engineer, disassemble, decompile, or otherwise attempt to derive source code from the App
- Sublicence, sell, rent, lease, or otherwise transfer rights in the App to any third party
- Remove any proprietary notices or labels on the App
- Use the App to develop a competing product or service
- Use automated tooling, multiple accounts, or any other technique to manipulate poll votes, mosaic reactions, or any other engagement counter on the App
- Abuse the in-app report or block features (including bad-faith or mass reporting)
- Republish, redistribute, or commercially exploit any other user’s content saved via the “Echoed” feature outside the App
3. Updates
Foundry26 may release updates, patches, or new versions of the App. Your continued use of the App after any update constitutes acceptance of the updated EULA. Foundry26 reserves the right to discontinue the App or any feature at any time.
4. Third-Party Terms
The App uses third-party services including Firebase (Google LLC) and Pexels (Canva Pty Ltd). Your use of those services is also governed by their respective terms and privacy policies. See our Privacy Policy §9 for the full list.
5. Apple-Specific Terms
If you downloaded the App from the Apple App Store, the following applies:
- Acknowledgement: This EULA is between you and Foundry26 only, not Apple. Apple is not responsible for the App or its content.
- Maintenance and Support: Apple has no obligation to furnish any maintenance or support services for the App. Foundry26 is solely responsible for any product warranties.
- Product Claims: Foundry26, not Apple, is responsible for addressing any claims relating to the App or your use of it.
- Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
6. Google-Specific Terms
If you downloaded the App from Google Play, the Google Play Terms of Service also apply. This EULA is between you and Foundry26 only; Google is not a party to this agreement.
7. Intellectual Property
The App and all content, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, and the design, selection, and arrangement thereof) are owned by Foundry26 and are protected by UK and international copyright, trademark, and other intellectual property laws.
8. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from Foundry26 if you fail to comply with any of its terms. Upon termination, you must destroy all copies of the App in your possession. Sections 7, 9, and 10 survive termination.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOUNDRY26 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOUNDRY26 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED £100 GBP.
11. Governing Law
This EULA is governed by the laws of England and Wales, without regard to its conflict of law provisions.
